Contra Costa Residents Assist Police In Arrest of Burglary Suspect

Four people were arrested Friday when they allegedly tried to burglarize a home but instead ran into a village of vigilant citizens.

The drama unfolded for nearly 90 minutes after a neighbor called 911 to report that three unknown people had jumped a fence in the 1400 block of Reliez Valley Road.

A police search led to the arrest of 18-year-old Rashawn Ragland-Smith, 18-year-old Edward Moore and two 16-year-old boys. Moore, like Ragland-Smith, was being held in County Jail in Martinez on suspicion of burglary, weapons violations and resisting arrest, Lee said. The two 16-year-olds were taken to Juvenile Hall.

Minutes after the three suspects hopped the fence, police received another call from a resident saying an alarm was going off at the same location, Lee said. Three of the teens ran, but a fourth tried to drive away in a Ford. A citizen’s “good description” of that vehicle led police to follow it, Lee said, and officers pulled it over on Pleasant Hill Road.

Inside the vehicle police found property stolen in a previous residential burglary in Concord, Lee said. The driver surrendered.

Video Store Clerk Lies About Robbery to Cover Up Felony Embezzlement

A San Rafael video store clerk who reported a robbery last month fabricated the story to hide her own theft of about $1,200, police said.

The 25-year-old Silver Screen Video clerk told police that two men dressed in black with hoods pulled over their faces robbed the Montecito Shopping Center store Nov. 9 at knifepoint, San Rafael police spokeswoman Margo Rohrbacher said at the time.

However, after reviewing surveillance video from neighboring businesses, police determined that no suspects matching the descriptions had been at the shopping center at any time around 10 p.m. that day, Lt. Dan Fink said.

After speaking with the clerk, police determined she had taken the money herself, Fink said. She is suspected of felony embezzlement and making a false report to a peace officer.

Hit and Run Kills Man Helping with Jump Start

The driver of an RV was arrested on suspicion of hit and run for allegedly running over and killing a man who had helped him with a jump start in Fairfield, police said.

Rudy Gonzales, 70, of Hayward was run over by the RV in the parking lot of a McDonald’s restaurant on Central Way about 10 a.m. Thursday, said Fairfield police Lt. Greg Hurlbut.

Moments earlier, Gonzales had offered to help the RV’s driver, Michael Wilbert, 52, of Fairfield, with a jump start, Hurlbut said.

Gonzales was “somehow struck by the recreational vehicle” while getting the engine started, Hurlbut said.

Wilbert drove off without helping Gonzales, who died at the scene, police said.

Wilbert was found shortly afterward at a nearby business and arrested on suspicion of vehicular manslaughter and hit and run. He did not appear to be drunk, Hurlbut said.

Court Proceedings Delayed Again in Michelle Le Murder Case

Court proceedings in the case of a Union City woman charged with murdering San Mateo nursing student Michelle Le have once again been postponed.  Proceedings in the case were initially delayed due to undisclosed medical issues on Sept. 8. They were postponed again when Esteban attempted to fire her Public Defender Andrea Auer on Oct. 24. The request was later denied.

Giselle Diwag Esteban, 27, is scheduled to return to court Jan. 6 to enter a plea.

Though Le’s body was missing at the time of Esteban’s arrest, police said evidence, including Le’s DNA found on Esteban’s athletic shoes, footage from security cameras at the Kaiser Permanente parking structure, cell phone records and evidence found inside Le’s car, led to Esteban’s arrest.  Esteban is the lone suspect charged with the murder of Le, 26.

Teen Charged with Attempted Murder for Shooting an Ice Cream Vendor

A Vallejo teenager was sentenced  Tuesday to seven years to life in prison for attempted murder and 10 years for using a gun to shoot an ice-cream vendor in the chest during an attempted robbery last year.

Montenegro was a 15-year-old Hogan High School freshman when he and Joseph Beverly, then 14, tried to rob Amarjit Kaur as she sat in her ice cream truck on Springs Road in Vallejo. Beverly pleaded guilty to robbery earlier this year.

Kaur, a 39-year-old widow raising three children, was found slumped behind the wheel of Tony’s Ice Cream truck on Feb. 3, 2010.  Montenegro shot Kaur because she apparently didn’t understand his demands or react quickly enough, investigators said.
